American Furniture Warehouse Corporation (dba American Furniture Galleries) v. American Furnishing Gallery, LLC, Nguyen, et al. (Tracy) United States District Court, Eastern District of California, 2016 – Represented plaintiff AFWC in prevailing on trademark infringement and other claims, resulting in defendants changing name to one agreeable to AFWC, together with defendants changing all marketing materials, signage, etc.

Ring Yuba City, LLC v. Big Lots, et al., Sutter County, 2016 – Served as lead trial counsel and secured jury verdict in favor of plaintiff, former owner of substantial and improved commercial property in Northern California that was damaged by former long-term tenant.

Boudreau v. James Martin, et al., Sacramento County, 2016 – Represented group of nine individual person plaintiffs, some of whom terminally ill, in civil prosecution of chiropractor James Martin for fraud, malpractice, practicing medicine without a license, and other claims stemming from his criminally fraudulent treatment of plaintiffs and theft of tens of thousands of dollars.

On behalf of client P2O Hot Pilates & Fitness, 2016 – Closed long-term commercial lease deal paving the way for premier midtown Sacramento fitness studio to expand into new, substantially larger and custom built-out flagship location.

Richards v. Starr’s Building Supply, United States District Court, Eastern District of California, 2016 – In federal bench trial stemming from action filed by trustee against highly regarded, family-owned construction supply business client, successfully defeated trustee’s claims and attempts to overturn a $730,000-plus state court judgment HLG previously secured on the client’s behalf against a contractor refusing to pay for substantial supplies and materials.

Rawles v. Simpson, et al., Placer County, 2016 – On behalf of Rawles, won state court trial verdict against all defendants on claims stemming from defendants’ fraudulent business practices and misappropriation of monies and equipment.

Martin v. Muse ArtHaus, Sacramento County, 2016 – Successfully defended local premier salon and art gallery against civil action and separate Department of Labor complaint brought by former independent contractor claiming wage-and-hour and various Labor Code violations.

State of California v. Carthen, et al., Sacramento County, 2015 – Represented defendants against claims from State of California, Department of Resources and Recovery, of fraudulent business practices in defendants’ operations of multiple resources recycling sites and obtained substantially favorable settlement and secured state’s dismissal of all claims.

Stollmeyer v. Sears, Roebuck and Company, et al., San Joaquin County, 2015 – Represented Stollmeyer in successfully recovering substantial monies in medical and personal compensation for her undisputed and severe injuries experienced within a Sears showroom as a direct result of employee misfeasance.

Gallego v. Sherali, Yolo County, 2014 – On behalf of defendant Sherali, after lengthy litigation obtained complete and total defense victory settlement involving plaintiff simply dismissing its lawsuit in its entirety with mutual walk-away.

Lanktree v. Creative Solutions in Elder Care, LLC, et al., Sacramento County, 2014 – Prevailed at trial against owner-operators of substandard, dangerous elder care facility and succeeded in effecting permanent closure of the facility and safe relocation of all patients.

Cemo Family Charitable Foundation v. Deepal Wannakuwatte, et al., Sacramento County, 2014 – Represented plaintiffs in civil prosecution of Wannakuwatte and other defendants responsible for criminal Ponzi scheme and stealing several millions of dollars from local investors, and succeeded in obtaining court judgment against primary wrongdoers.

People of the State of California v. Sherali Davis, LLC, Sierra County, 2014 – Successfully defended and favorably resolved criminal claims from the Sierra County District Attorney claiming sales of nonstandard petroleum products.

Oates Development Group, LLC v. Adkins, et al., Sacramento County, 2014 – On behalf of Oates Development, filed suit and obtained total and complete victorious settlement in unconditional return of significantly valuable, commercial-grade electrical transformer equipment misappropriated by buyer-defendants after purchase and sale of improved commercial property.

Sherali v. Luth, et al., Yolo County, 2014 – Represented plaintiffs and after substantial litigation obtained valuable settlement on claims of malpractice and breach of insurance agreement relating to coverage of certain commercial losses at gasoline stations and convenience stores owned by the Sheralis.

Desy v. Bell (Estate of Farmer), Sacramento County, 2014 – Represented plaintiff in action to enforce terms of Farmer’s will and testament and prevent defendant from continuing estate theft, and secured favorable settlement in line with Farmer’s wishes.

Cosgrove v. AmeriVet Logistics, Inc., 2013, Sacramento County – After years of litigation representing AmeriVet and other defendants, successfully resolved the matter with favorable resolution resulting in AmeriVet buying out former investors and acquiring sole ownership and control of business.

State of California v. Fast and Easy Mart, Yolo County, 2013 – Successfully defended and favorably resolved complaints by the California Labor Commissioner alleging various wage-and-hour violations.

American Furniture Warehouse Corporation (dba American Furniture Galleries) v. American Furniture, Pham, et al. (Gilroy) United States District Court, Eastern District of California 2013 – Represented plaintiff AFWC in prevailing in federal action trademark infringement and other claims, resulting in defendants ceasing using existing name and going out of business.

Tolen v. Mondragon, Sacramento County, 2013 – Represented Tolen and on his behalf obtained court judgement against defendant for loss of substantial monies after breach of promoter and concert agreement.

Client Confidential (Public Figure), 2013 – On behalf of owner and host of Northern California and Northern Nevada premier morning broadcast radio entertainment program, served as lead counsel and negotiator in securing lucrative, long-term contract with one of top five largest broadcast radio companies in the United States.

Odyssey Landscape Company, Inc., et al., San Joaquin County, 2013 – After three-month-long bench trial in case involving plaintiffs who sought in excess of $2 million, achieved complete defense verdict on behalf of defendants against panoply of claims of public works projects worker classification, wage-and-hour, etc.

(Yuba City) United States District Court, Eastern District of California, 2012 – Represented plaintiff AFWC in prevailing in federal action trademark infringement and other claims, resulting in defendants changing name to one agreeable to AFWC, together with defendants changing all marketing materials, signage, etc.

McGraw-Hill Companies, Inc. v. Davis Textbooks, Yolo County, 2012 – Obtained highly valuable settlement on behalf of Davis Textbooks against plaintiffs’ claims of multi-million dollar transactions in alleged counterfeit textbooks.

Significant Pro Bono Trial Work

Desy v. CalStar, El Dorado County, 2011 – On a pro bono basis, represented plaintiff, an injured military veteran and helicopter pilot, in successfully and favorably resolving wrongful termination claims against emergency medical airlift company.

Ervine v. California Department of Corrections, et al., United States District Court for the Northern District of California, 2005 – On pro bono basis, served as lead trial counsel in high-profile case and secured federal jury trial verdict in favor of highly decorated Vietnam veteran, San Quentin Death Row inmate client who was denied core Constitutional rights during imprisonment which led to near-fatal conditions.

Client Confidential (Minor Child), 2005 – As pro bono Panel Counsel for San Francisco Legal Services for Children, represented wrongfully accused minor child in Alameda County School District administrative trial in successful defense of accusations that child possessed lethal weapon on school grounds and posed serious threat in classroom.

Published Cases

Acrymed, Inc. v. Convatec, (a division of Bristol-Myers Squibb Company) 317 F. Supp. 2d 1204 (D. Or. 2004) – Served as co-counsel in patent infringement and trade secrets case, and on summary judgment motion succeeded in securing dismissal of certain of plaintiff’s critical claims against Convatec and Bristol-Myers, which led directly to highly favorable settlement.
